Terms of Service

1. The service

FanConvert helps creators connect their Patreon and Shopify accounts. When one of your supporters joins, updates, or cancels their membership on Patreon, FanConvert applies the matching membership label to the corresponding customer record in your Shopify store. We do not modify your orders, products, prices, or content. We may add, change, or remove features at any time without notice.

2. Your account

• You must own, or be authorized to manage, the Patreon page and the Shopify store you connect, and you must keep your account information accurate.
• Each plan includes a monthly allowance. Once you reach the allowance, additional updates that arrive that month may not be processed until the next calendar month or a plan upgrade.
• We may change plans, allowances, pricing, or features at any time. Plan changes generally take effect at the start of the next calendar month.

3. Acceptable use

You agree not to:

• Reverse-engineer, probe, intercept, overload, or otherwise interfere with the Service or its underlying systems.
• Use the Service to apply membership labels, or to take any action, that violates the terms of Patreon or Shopify, or any applicable law (for example, discriminatory or harassing labels).
• Send, or attempt to send, forged or unauthorized requests to the Service, or attempt to access another account's data.
• Use the Service in violation of any third party's rights, including privacy, intellectual property, or contractual rights.

You are solely responsible for the data you connect to the Service and for ensuring that your use of FanConvert complies with all laws and third-party terms that apply to you.

4. Fees and refunds

Pricing for each plan is shown on the dashboard. Plans are billed through FanConvert's own Patreon page — your pledge tier there determines your FanConvert plan tier. All sales are final and we do not provide refunds, except where required by law. Refund disputes for Patreon pledges are handled by Patreon under their refund policy.

5. Suspension and termination

You may stop using FanConvert at any time by disconnecting it from your Patreon settings (Apps) or your Shopify admin (Apps → FanConvert → Uninstall). Disconnecting halts processing for your account immediately.

We may suspend or terminate your access at any time, with or without notice, for any reason, including if we believe your use of the Service violates these terms, presents a security or legal risk, or is otherwise harmful to FanConvert, its other users, or any third party. Sections that by their nature should survive termination will survive (including disclaimers, limitations of liability, indemnification, and governing law).

6. Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory. To the maximum extent permitted by law, we disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, security, and uninterrupted or error-free operation. We do not guarantee that every membership update will be processed, that processing will occur within any particular time, or that the Service will always be available. Your use of the Service is at your own risk.

7. Limitation of liability

To the maximum extent permitted by law, FanConvert and its owners, employees, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or relating to your use of (or inability to use) the Service, even if we have been advised of the possibility of such damages.

Our total cumulative liability for all claims arising out of or relating to the Service is limited to the lesser of (a) the amount you paid for the Service in the three (3) months immediately preceding the event giving rise to the claim, or (b) one hundred US dollars (US$100). These limits apply regardless of the theory of liability and even if a remedy fails of its essential purpose.

8. Your indemnification of FanConvert

You agree to defend, indemnify, and hold harmless FanConvert and its owners, employees, and service providers from and against any claim, demand, loss, liability, damage, cost, or expense (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) your supporters' information or any other data you connect to the Service; (c) your violation of these terms or any applicable law; or (d) your violation of any third party's rights, including the terms of Patreon or Shopify.

9. Third-party services

FanConvert relies on third-party services, including Patreon, Shopify, and the providers listed in our Privacy Policy. We are not responsible for the availability, accuracy, content, or policies of those services, and your use of them is governed by their own terms.

10. Force majeure

We are not liable for any delay or failure to perform caused by events outside our reasonable control, including acts of God, natural disasters, internet or power outages, third-party service failures, labor disputes, or governmental action.

11. Changes to these terms

We may update these terms from time to time. Updates take effect when posted, and we will update the “Last updated” date at the top. Your continued use of the Service after an update means you accept the revised terms. If you do not agree to a change, you must stop using the Service.

12. Governing law and venue

These terms are governed by the laws of the State of Texas, USA, excluding its conflict-of-laws rules. You agree that any dispute arising out of or relating to these terms or the Service will be resolved exclusively in the state or federal courts located in Texas, and you consent to the personal jurisdiction of those courts.

13. General

These terms, together with our Privacy Policy, are the entire agreement between you and FanConvert regarding the Service and supersede any prior agreements on the same subject. If any provision is found unenforceable, the remaining provisions will stay in full effect. Our failure to enforce any provision is not a waiver of our right to enforce it later. You may not assign these terms without our prior written consent; we may assign them at any time. These terms do not create any third-party beneficiary rights.
